These terms apply to every HubSpot CMS theme published by digitalmakers.cat, including DM Strukt, DM Lab, DM Cargo and DM Tech (each a "Theme"), whether free or paid, obtained through the HubSpot Template Marketplace.
The Themes are published by Enginytic SL, with registered office at C/ Santa Clotilde, núm. 6, baixos 2, 08012 Barcelona (Barcelona) and tax ID B65506909, trading as digitalmakers.cat ("we", "us"). Contact: info@digitalmakers.cat.
You obtain the Theme through the HubSpot Template Marketplace. HubSpot's Template Marketplace terms govern the purchase, payment, refunds and delivery of the Theme. These license terms add the conditions under which you may use the Theme itself. If the two conflict, HubSpot's terms prevail on purchase, payment and refunds.
We grant you a non-exclusive, non-transferable, worldwide license to:
Agencies may use the Theme to build sites for clients, provided the Theme is installed in the client's own HubSpot account through the Marketplace.
Demo texts, company names, people, figures and addresses in the Theme are fictitious placeholders and must be replaced with your own content before publishing. The illustrations included in the Theme are original works created by us. You may use them on websites built with the Theme, but not separately from it.
The Theme may load third-party services such as Google Fonts or an embedded Google Map. Their use is subject to the providers' own terms and privacy policies. You are responsible for informing your website visitors and obtaining any consent required by law (for example under the GDPR) for those services.
We may release updates to fix errors, keep compatibility with HubSpot or add features. Updates are delivered through HubSpot at no extra cost. We recommend making code changes in a child theme so updates do not overwrite them.
We provide support by email at info@digitalmakers.cat in English, Spanish and Catalan, and we fix errors in the Theme as required by HubSpot's Marketplace guidelines. Support covers installing and configuring the Theme and the features described in its documentation. It does not cover custom development, third-party integrations or changes made to the Theme's code.
We build the Theme with care and test it in HubSpot. Except as required by applicable law, the Theme is provided "as is", without warranty that it will meet every specific requirement or work without interruption in combination with other code, modules or integrations.
To the extent permitted by law, our total liability arising from the Theme is limited to the amount you paid for it. We are not liable for indirect or consequential damages such as loss of profits, data or business. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer.
The license ends automatically if you breach these terms. On termination you must stop using the Theme and remove it from your HubSpot account(s).
We may update these terms. The version published on this page, with its date, applies from that date. Changes do not affect licenses already granted for versions you obtained before the change.
These terms are governed by Spanish law. Disputes will be handled by the courts of Barcelona, unless consumer protection law gives you the right to go to the courts of your place of residence.
